1. Agreement to Terms
By purchasing, subscribing to, using, or requesting services from Creamer Digital LLC (“Creamer Digital,” “we,” “us,” or “our”), you agree to these Terms & Agreement. If you do not agree, you should not purchase or use the services.
2. Services Provided
Creamer Digital provides website design, website development, website hosting, ongoing maintenance, content management system setup, basic SEO optimization, business email/domain support, graphic design, analytics/reporting, and digital phone service depending on the selected plan. Exact services vary by package and may change over time.
3. Plans, Subscriptions, and Stripe Checkout
Plan purchases are processed through Stripe checkout links. Stripe may collect payment information, billing details, tax information, and other information required to process payments. Creamer Digital does not control Stripe’s systems and is not responsible for Stripe outages, declined payments, payment disputes, or Stripe account requirements.
Subscription fees are billed according to the plan selected at checkout. Customers are responsible for maintaining valid payment information and ensuring payments are made on time.
4. Free Trial and Upgrade Path
The Free plan is described as a trial option, currently presented as a 30-day trial. Trial features, limits, duration, and upgrade path may change. At or after the end of the trial, customers may be offered a paid plan. If the customer does not upgrade or continue service, Creamer Digital may suspend or remove trial services.
5. Customer Responsibilities
Customers are responsible for providing accurate business information, brand assets, text, images, logos, approvals, account access, DNS/domain details, and any other materials needed to complete the website. Customers must have the legal right to use any content they provide.
Delays in providing materials, feedback, approvals, or access may delay project delivery and do not automatically pause subscription billing unless Creamer Digital agrees in writing.
6. Content Ownership and License
Customers retain ownership of customer-provided content. By providing content to Creamer Digital, the customer grants Creamer Digital permission to use, edit, format, publish, host, and display that content as needed to provide the services.
Design layouts, templates, code snippets, systems, workflows, and reusable components created or used by Creamer Digital may be reused across projects unless otherwise agreed in writing.
7. Revisions, Scope, and Change Requests
Plan pricing includes a reasonable level of setup, design, and support based on the selected package. Requests outside the normal scope of the plan — including advanced custom features, integrations, copywriting, large content migrations, ecommerce, custom applications, complex automation, or unusual technical requirements — may require a different plan, custom quote, or additional fees.
8. Hosting, Domains, Email, and Third-Party Services
Hosting, domain registration, DNS, email, analytics, payment processing, phone services, plugins, templates, and other tools may involve third-party providers. Creamer Digital is not responsible for outages, limitations, policy changes, price changes, or data practices of third-party providers.
Domain names and email services may require customer cooperation, verification, and ongoing payment. Failure to renew domains or maintain required third-party accounts may interrupt service.
9. SEO, Analytics, and Performance
Creamer Digital may provide basic SEO optimization, analytics setup, and reporting depending on the plan. However, Creamer Digital does not guarantee search rankings, traffic volume, leads, sales, revenue, advertising performance, or specific business outcomes.
10. Support and Maintenance
Ongoing maintenance and support are provided according to the selected plan. Support may include basic website updates, troubleshooting, hosting assistance, plugin/theme updates, and minor content changes. Response times are not guaranteed unless a separate written service-level agreement exists.
11. Acceptable Use
Customers may not use Creamer Digital services for unlawful, fraudulent, abusive, malicious, infringing, hateful, harassing, deceptive, spam-related, malware-related, or otherwise harmful activity. Creamer Digital may suspend or terminate services if a site creates security, legal, abuse, reputational, or operational risk.
12. Security and Sensitive Information
Customers should not submit passwords, MFA codes, API keys, private keys, payment card details, regulated data, protected health information, confidential client files, or other sensitive information through public website chat or general website forms unless Creamer Digital provides an approved secure process.
Creamer Digital will take reasonable steps to protect website systems, but no website, hosting environment, or internet service can be guaranteed completely secure.
13. Chatbot and Automated Assistance
The Creamer Digital chatbot is intended to answer general questions, explain plans, and guide visitors to signup links. Chatbot responses may be incomplete or inaccurate and should not be treated as legal, financial, tax, security, or professional advice. The chatbot cannot complete purchases, create binding agreements, or guarantee service availability.
14. Cancellations, Suspension, and Termination
Customers may cancel according to the applicable Stripe/subscription process and any written agreement. Cancellation may affect hosting, maintenance, email/domain support, website availability, and access to ongoing support. Creamer Digital may suspend or terminate services for nonpayment, abuse, security risk, violation of these terms, or discontinued service availability.
15. Refunds
Refunds are not guaranteed unless required by law or expressly approved by Creamer Digital. Setup work, design work, hosting, third-party costs, domain-related costs, and completed services may be non-refundable.
16. Limitation of Liability
To the maximum extent permitted by law, Creamer Digital is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, search ranking changes, or third-party service failures.
17. No Warranty
Services are provided on an “as available” and commercially reasonable basis unless otherwise stated in writing. Creamer Digital does not warrant that services will be uninterrupted, error-free, fully secure, or compatible with every third-party platform, browser, plugin, or device.
18. Changes to Terms
Creamer Digital may update these terms from time to time. Continued use of the services after updates means the customer accepts the revised terms.
